NAA/NMHC Weigh In on Disparate Impact Theory to the
Supreme Court
On
Sept. 3, NAA/NMHC joined other real estate groups in filing a "friend
of the court" brief in the Mount Holly v. Mount Holly Gardens Citizens
in Action, Inc case pending before the Supreme Court. The
outcome of the case will determine if disparate impact claims are
allowable under the Fair Housing Act (FHA). Disparate impact theory
refers to seemingly neutral policies that may have a disproportionate,
adverse effect on members of a protected class, regardless of
discriminatory intent.
The
court's decision could affect common multifamily business policies,
such as resident screening, occupancy limitations and Section 8 voucher
policies.
The coalition brief supported the position that the act does not recognize disparate impact claims. It
also argued that disparate impact liability is a judge-made rule that
improperly extends the scope of the Fair Housing Act and creates de
facto protected classes.
