Legislative Pulse


The CAA Legislative Pulse is a monthly newsletter designed to keep Charleston Apartment Association members abreast of topical political news impacting the industry.  The CAA Legislative Pulse is released to members the fourth Tuesday of each month.

NOVEMBER ELECTIONS  
CHARLESTON APARTMENT ASSOCIATION BOARD OF DIRECTORS

Calling for nominations for the 2014-2015, Charleston Apartment Association, Board of Directors & Executive Board.   Please nominate an individual for each position that you know is dedicated to the success of the Charleston Apartment Association and is available to perform the duties pertaining to the Association.  Please click here for the nomination ballot.  Nominations are due to Association Executive: Katie Chapman at kchapman@charlestonapartmentassociation.com by October 7, 2013.     

All Board Member positions are up for election in November 2013. This includes the four (4) Executive Officers and eight (8) Board Member positions.

Executive Officers, include the President, Vice President, Treasurer and Secretary, and these individuals must have served on the Board at least one time in the past.  The Secretary position must be an Associate (vendor) Member, and the remaining Executive Officer positions are Direct (owner/manager) Members.

The Board of Directors consists of three (3) Associate (Vendor) Members and five (5) Direct Members.

Live Auction:  Lunch & Breakfast dates with area Senior Leadership members of owner/manager groups will be auctioned off to any interested parties/members attending the meeting.
Silent Auction:  Goods and Services will be auctioned off at the dinner meeting.  All proceeds will go to NAA PAC.  Please reach out to Katie Chapman if you have goods or services you are willing to donate, or just come ready with your checkbook to secure some of the amazing donated items!

NAA/NMHC Weigh In on Disparate Impact Theory to the  
Supreme Court

On Sept. 3, NAA/NMHC joined other real estate groups in filing a "friend of the court" brief in the Mount Holly v. Mount Holly Gardens Citizens in Action, Inc case pending before the Supreme Court.  The outcome of the case will determine if disparate impact claims are allowable under the Fair Housing Act (FHA). Disparate impact theory refers to seemingly neutral policies that may have a disproportionate, adverse effect on members of a protected class, regardless of discriminatory intent.

The court's decision could affect common multifamily business policies, such as resident screening, occupancy limitations and Section 8 voucher policies.

The coalition brief supported the position that the act does not recognize disparate impact claims.  It also argued that disparate impact liability is a judge-made rule that improperly extends the scope of the Fair Housing Act and creates de facto protected classes.
